The draft law on Construction, Residential Housing, Real Estate Business, Planning and Tendering amends four existing laws, including the Law on Construction 2014, the Law on Housing 2014, the Law on Real Estate Business 2014 and the Law on Urban Planning 2009.
The objective of the amendments is to simplify time consuming and complicated procedures related to construction, such as obtaining planning approval and construction permits.
The recent issuance of laws such as the Law on Planning also required amendments to the legal framework in the construction and real estate business sector to ensure consistency in the legal system.
The government states that a decree would be compiled to remove 41.3 percent of the existing construction business prerequisites while simplifying another 43.7 percent.
It is intended that the draft law will be brought to the National Assembly for discussion in May, and the proposed law would be passed and come into effect for the beginning of 2019.
The draft law amends the following aspects of the Construction Law, 50/2014/QH13, regarding the approval of construction plans, including, types and levels of construction works, requirements and principles of compliance in respect of construction master plans, the responsibility to seek opinions on construction master plans, requirements and selection of consultants to formulate a construction master plan, conditions for amending construction master plans, and entities and types of construction permits.
Managerial aspects of construction projects are also amended in the draft, as are conditions for issuing and amending construction permits.
The draft law amends the Residential Housing Law, 65/2014/QH13, specifically, the Conditions for being a developer of a project for construction of commercial residential housing.
Law 660/2014/QH13 on Real Estate Business is amended in the following provisions: Conditions applicable to organizations and individuals engaged in the real estate business, real estate brokerage services, and real estate trading floors.
Law 30/2009/QH12 on Urban Planning is amended in the selection and terms of consultants to prepare an urban master plan, conditions to amend urban master plans, and responsibility to publish urban master plans.
Law 43/2013/QH13 on Tendering is amended regarding the appointment of a contractor and consultant.
