On November 9th, 2018, the Government issued Decree No.154/2018/ND-CP (“Decree 154”) amending, supplementing, and abolishing some regulations regarding investment and conduct of business conditions in the sectors managed by the Ministry of Science and Technology and some regulations on specialized inspection.

Decree No. 87/2016/ND-CP dated July 1st, 2016 about conditions in doing business in motorbike helmets has been abolished.

Decree 154 also amends, supplements, and abolishes some articles of Decree No. 105/2016/ND-CP dated July 1st, 2016 about the operational conditions of organizations providing inspection, testing and measuring services. Some articles regarding conditions for conducting conformity assessment services in Decree No. 132/2008/ND-CP dated December 31st, 2008 have also been adjusted by Decree 154.

Accordingly, enterprises must register for State inspection of the quality of imported goods in compliance with Form No. 1 in the Appendix to this Decree, enclosed with the following documents: copy of contracts, packing lists (if any), bill of lading, invoice, customs declaration, certificate of quality, certificate of origin, pictures or description of the goods with compulsory contents on the goods labels and auxiliary labels (if the main label does not meet the prescribed contents); free circulation certificate (if any). The importers shall take full legal responsibility for the quality of the imported goods.

Decree 154 also specifies the conditions for exemption for quality inspection of goods in Group 2 as follows: For imported goods with the same name, utility, trademark, type and technical characteristic of the same production establishment, originating from the same importer, after three consecutive imports, with the assessment results to comply with national technical regulations, are able to be exempted from State quality inspection in the duration of two years.

The Decree came into force on November 9th, 2018.
