Circular 10, dated 24 May 2018, was promulgated to establish a framework for training on knowledge of the law on multi-level marketing (MLM),  as well as checks, issuance and revocation of certificates of knowledge of the law on MLM.

The circular applies to organisations that provide training and certifications regarding MLM law. The framework states that the training shall be a minimum of 8 hours and the application of the organisation shall be in accord with the form provided in the annexe to the circular.

The Department of the Department for Competition and Consumer Protection shall, according to Article 8, revoke a certificate of knowledge of the law on MLM where the application contains fraudulent information, where the MLM enterprise terminates its multi-level marketing operation, or where the person issued with the certificate of training on knowledge of the law on MLM terminates his or her labour contract or training with the MLM enterprise.

The MLM enterprise must notify the Department in the event of any of the termination or resignation of the labour contract of the trained person.

The Circular comes into effect as from 15 July 2018, and repeals Circular 24/2014/TT-BCT of MOIT dated 30 July 2014 implementing Decree 42 dated 14 May 2014 on management of multi-level marketing.
